1. The Service

Darktape AI lets you generate found-footage stills and VHS-style horror clips from text prompts, optional reference images, and preset vault styles. We rely on third-party providers for authentication, generation, storage, and billing. Features may change over time.

2. Eligibility

You must be at least 18 years old to use the Service. You are responsible for your account credentials and all activity under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or third-party rights.
• Upload images of real people, celebrities, or public figures without lawful rights and consent, or to create non-consensual or deceptive depictions of real individuals.
• Generate content that promotes real-world violence, hate, harassment, or illegal activity against actual people or groups.
• Infringe copyrights, trademarks, or other intellectual property (including major studio characters you do not own).
• Abuse, scrape, or overload the Service; circumvent rate limits, credits, or access controls; or reverse engineer underlying models or systems.

Fictional horror content — including graphic imagery typical of the genre — is permitted when it complies with these Terms and our content policies. We may review prompts and outputs and suspend or terminate accounts that violate these rules.

4. Your content and license

You retain ownership of prompts you submit and generations you create, subject to third-party model terms and applicable law. You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display your prompts and generations as needed to operate, secure, support, and improve the Service. AI outputs may not be unique; similar prompts may produce similar results for other users.

5. Credits, billing, and refunds

Paid plans and credits are processed through our payment provider. Fees are disclosed at checkout. Except where required by law, purchases are non-refundable once credits are granted or used. We may change pricing with notice where required.

6. Third-party services

The Service integrates with third-party providers. Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party outages or practices.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. AI-generated content may be inaccurate, offensive, or unexpected. You use the Service and any outputs at your own risk.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM.

9. Termination

We may suspend or terminate access for violations of these Terms or to protect the Service. You may stop using the Service at any time. Provisions that should survive termination (including licenses, disclaimers, and liability limits) remain in effect.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes shall be brought in the state or federal courts located in New Castle County, Delaware, unless otherwise required by law.

11. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance.
